Kamusal alan\u0131n en \u00f6nemli niteli\u011fi t\u00fcm vatanda\u015flara a\u00e7\u0131k olmas\u0131d\u0131r. Kamusal alan\u0131n bir b\u00f6l\u00fcm\u00fc, \u00f6zel vatanda\u015flar\u0131n birbirleriyle bir kamu organ\u0131 yaratt\u0131klar\u0131 her t\u00fcrl\u00fc ileti\u015fim sayesinde yarat\u0131l\u0131r.1 Buna g\u00f6re, kamusal alan i\u00e7inde bireyler ne \u00f6zel alan\u0131n \u00fcyeleri olan i\u015fadam\u0131\/i\u015fkad\u0131n\u0131 ya da profesyoneller gibi, ne de devlet b\u00fcrokrasisinin yasal yapt\u0131r\u0131mlar\u0131na m\u00e2ruz kalan anayasal d\u00fczenin \u00fcyeleri gibi davranabilirler. Buna kar\u015f\u0131l\u0131k, edebi alan\u0131n tersine, kamusal alandan bahsetti\u011fimizde, kamuoyunda tart\u0131\u015f\u0131lan konunun bir \u015fekilde devletle ilgili olmas\u0131 d\u00fc\u015f\u00fcncesi akla gelmekte.2 Her ne kadar devlet otoritesi siyasal kamu alan\u0131nda icra etmekten (execute) sorumlu olsa da, bu alan\u0131n bir par\u00e7as\u0131 de\u011fildir. Her ne kadar fikirler (k\u00fclt\u00fcrel say\u0131lt\u0131lar, normatif tutumlar, kollektif \u00f6nyarg\u0131lar ve de\u011ferler) tarihin bir t\u00fcr kal\u0131nt\u0131s\u0131 olarak do\u011fal bi\u00e7imleri i\u00e7inde s\u00fcregelseler ve geli\u015fseler de, kamuoyunun varl\u0131\u011f\u0131 kararlar al\u0131p verebilen, dinamik bir kamunun varl\u0131\u011f\u0131na ba\u011fl\u0131d\u0131r. Siyasal erkin icra edilmesine ili\u015fkin gruplar taraf\u0131ndan yap\u0131lan i\u00e7erik a\u00e7\u0131s\u0131ndan ele\u015ftirel ve kurumsal olarak garantilenmi\u015f kamuda yap\u0131lan tart\u0131\u015fmalar, burjuva toplumunun \u00f6zel bir tarihsel d\u00f6neminde geli\u015fti ve burjuva anayasal devletine sadece belirli \u00e7\u0131karlar\u0131n biraraya gelmesi sonucu olarak girebildi.<\/p>\n<p>Tarih<\/p>\n<p>Orta\u00e7a\u011f Avrupa toplumunda \u00f6zel\/kamu alan\u0131 ayr\u0131m\u0131 oldu\u011funu g\u00f6steren bir fakt\u00f6r olmamakla birlikte, bu d\u00f6nemde egemenli\u011fi simgeleyen sembollerin (prens m\u00fch\u00fcr\u00fc) ayn\u0131 zamanda \u201ckamu\u201dyu simgelemesi bir raslant\u0131 olmasa gerek. Bu arada, ayn\u0131 tarihsel d\u00f6nemde erkin kamu taraf\u0131ndan temsil edilmesi ortaya \u00e7\u0131kt\u0131. Burjuva kamusal alan\u0131 anlam\u0131nda bir temsil, \u00f6rne\u011fin, ulusun temsili, kolayl\u0131kla ay\u0131rd edilebilir bir egemenin varl\u0131\u011f\u0131 ile belirlenen feodal kamu alan\u0131ndan farkl\u0131d\u0131r.<\/p>\n<p>Temsilci kamusal alanla ilk kez ba\u011flant\u0131s\u0131n\u0131 g\u00f6rd\u00fc\u011f\u00fcm\u00fcz feodal otoriteler (Kilise, prensler ve soyluluk) uzun bir kutupla\u015fma d\u00f6nemi s\u0131ras\u0131nda par\u00e7aland\u0131lar. 18. y\u00fczy\u0131l\u0131n sonunda s\u00f6zkonusu otoriteler bir taraftan \u00f6zel, di\u011fer yandan kamusal alana ayr\u0131ld\u0131lar. Bu arada kilisenin konumu Reform hareketi ile birlikte de\u011fi\u015fti: Kilisenin temsil etti\u011fi ilahi otorite, ya da din, \u00f6zel bir alan haline geldi. Dinsel \u00f6zg\u00fcrl\u00fck \u015feklinde betimlenen alan tarihsel olarak ilk \u00f6zel alan\u0131 garanti alt\u0131na alma i\u015flevini g\u00f6rmeye ba\u015flad\u0131. Feodal prensin otoritesinde g\u00f6r\u00fclen kutupla\u015fma da kamu b\u00fct\u00e7esinin h\u00fck\u00fcmdar\u0131n \u00f6zel hane b\u00fct\u00e7esinden ayr\u0131lmas\u0131 ile ger\u00e7ekle\u015fti. B\u00fcrokratik ve asker\u00ee kurumlar gibi kamu kurumlar\u0131 da, di\u011fer hukuk kurumlar\u0131yla beraber, kendilerini (feodal) prensin \u00f6zel alan\u0131ndan ay\u0131rarak ba\u011f\u0131ms\u0131z hale geldiler. En son olarak, feodal malikaneler de d\u00f6n\u00fc\u015f\u00fcme u\u011frad\u0131: soyluluk, kamu otoritesi, parlamento ve hukuk kurumlar\u0131n\u0131n bir organ\u0131 haline geldi; b\u00f6lgesel \u00f6rg\u00fctlenmelerde ve kentlerdeki \u015firketlerde \u00e7al\u0131\u015fan t\u00fcccar ve profesyoneller de devletten apayr\u0131 bir burjuva toplum alan\u0131 i\u00e7inde geli\u015fmeye ba\u015flad\u0131lar.<\/p>\n<p>Temsilci kamusal alan, yeni geli\u015fmekte olan ve kendisini \u00f6zel ya da b\u00f6lgesel devletlerle belli eden \u201ckamu otoritesi\u201dnin geli\u015fimini beraberinde getirdi. S\u00fcregelmekte olan devlet etkinlikleri (idare, ordu) b\u00f6ylece birtak\u0131m ili\u015fkilerin s\u00fcrekli haline gelmesine tekab\u00fcl etti. S\u00f6zkonusu ili\u015fkiler sayesinde bas\u0131n ve borsa gibi kurumlar mal de\u011fi\u015f-toku\u015fu ve bilgi al\u0131\u015fveri\u015fi a\u011f\u0131 i\u00e7inde geli\u015fmeye ba\u015flad\u0131lar. \u201cKamu\u201d kavram\u0131 otorite sahibi prensin sahiplendi\u011fi \u201ctemsilci\u201d mahkeme kavram\u0131na tekab\u00fcl etmekten \u00e7\u0131karak temelleri yetene\u011fe dayanan bir kurumu, ya da otoritenin yasal uygulamas\u0131 \u00fczerine tekel kurmu\u015f bir arac\u0131 tan\u0131mlamaya ba\u015flad\u0131. Kamusal otoritenin b\u00fct\u00fcnle\u015fti\u011fi devletin \u00e7at\u0131s\u0131 alt\u0131nda toplanan \u00f6zel bireyler ise bu noktada kamu organ\u0131n\u0131 olu\u015fturmaya ba\u015flad\u0131lar.<\/p>\n<p>Ger\u00e7ekte devlete kar\u015f\u0131 bir konumu olan \u00f6zel bir alan haline gelmi\u015f toplum ise, bir taraftan devlete kar\u015f\u0131 bir konumdaym\u0131\u015f gibi g\u00f6r\u00fcnd\u00fc. Di\u011fer yandan, toplumun giderek kamuoyunun ilgi alan\u0131na girmesiyle beraber, pazar ekonomisi geli\u015fmesinin ba\u015flang\u0131c\u0131ndaki \u00fcretim olgusu da \u00f6zel alandaki yerel otoritenin s\u0131n\u0131rlar\u0131n\u0131n d\u0131\u015f\u0131nda geli\u015fmeye ba\u015flad\u0131. Bu ba\u011flamda, burjuva kamusal alan\u0131 bireylerin kamusal organ i\u00e7inde \u00f6rg\u00fctlendi\u011fi \u00f6zel bireylerin alan\u0131 olarak anla\u015f\u0131labilir. S\u00f6zkonusu kamusal organ, resm\u00ee olarak kontrol edilen \u201centellekt\u00fcel gazeteler\u201de kendilerini kamusal otorite ile kar\u015f\u0131 konuma koymamalar\u0131n\u0131 telkin etmi\u015ftir.<\/p>\n<p>Kamu Alan\u0131 ve Liberal Model<\/p>\n<p>Kamuya a\u00e7\u0131k tart\u0131\u015fmalar\u0131n ortaya \u00e7\u0131kmas\u0131 tarihsel olarak kendine \u00f6zg\u00fc bir olayd\u0131. Lordlar prensle tart\u0131\u015farak kararlar ald\u0131lar. Bu geli\u015fme k\u0131ta Avrupa\u2019s\u0131 ile kar\u015f\u0131la\u015ft\u0131r\u0131ld\u0131\u011f\u0131nda, parlamentonun kraliyeti s\u0131n\u0131rlad\u0131\u011f\u0131 \u0130ngiltere\u2019de farkl\u0131 bir bi\u00e7im ald\u0131. K\u0131ta Avrupa\u2019s\u0131nda monarklar toprak sahipleri aras\u0131nda arac\u0131l\u0131k yapt\u0131lar. Soylulu\u011fun haklar\u0131n\u0131n ayr\u0131mla\u015fmas\u0131n\u0131n getirdi\u011fi erkin b\u00f6l\u00fc\u015f\u00fcm\u00fc, art\u0131k ekonomi kurumu i\u00e7inde olas\u0131 de\u011fildi (bu noktada kapitalist m\u00fclkiyet \u00fczerinde \u00f6zel alan\u0131n otoritesinin apolitik oldu\u011fu unutulmamal\u0131d\u0131r). Unutulmamal\u0131d\u0131r ki, burjuva bireyleri \u00f6zel bireylerdir. Buna ba\u011fl\u0131 olarak, \u201cegemen\u201d olamazlar. Burjuvalar\u0131n kamu otoritesinin yard\u0131m\u0131yla erk sahibi olmak istemeleri, \u201cpayla\u015f\u0131lmas\u0131\u201d gereken erkin bir noktada yo\u011funla\u015fmas\u0131na bir tepki de\u011fildir. Buna g\u00f6re, g\u00f6zetimcilik (supervision) ilkesi, yasalla\u015ft\u0131rman\u0131n temeli olmaktan \u00e7ok, erkin do\u011fas\u0131n\u0131 de\u011fi\u015ftirme arac\u0131 haline gelir.<\/p>\n<p>\u0130lk modern anayasalarda, temel haklara ili\u015fkin ilkeler liberal kamu alan\u0131 modelinin d\u00f6rt d\u00f6rtl\u00fck bir imaj\u0131yd\u0131: s\u00f6zkonusu hak ve \u00f6zg\u00fcrl\u00fckler toplumun bir kamusal alan olarak garantiye al\u0131nmas\u0131n\u0131 ve kamu otoritesinin birka\u00e7 i\u015flevle s\u0131n\u0131rland\u0131r\u0131lmas\u0131n\u0131 sa\u011flad\u0131. Kamu ve \u00f6zel alan aras\u0131nda anayasalar, ayn\u0131 zamanda kamusal alan i\u00e7inde yeralan bireylerin \u00f6zel alan\u0131n\u0131 korudu. S\u00f6zkonusu bireyler kamusal alan arac\u0131l\u0131\u011f\u0131yla politik otoriteyi \u201crasyonel\u201d otoriteye d\u00f6n\u00fc\u015ft\u00fcrebilmek i\u00e7in burjuva toplumunun gereksinmelerini devlete ileten vatanda\u015flar rol\u00fcn\u00fc oynad\u0131lar. Bu noktada, bu t\u00fcrden bir rasyonalitenin \u00f6l\u00e7\u00fct\u00fc olan kitlesel \u00e7\u0131karlar, serbest pazar ekonomisi i\u00e7indeki mal de\u011fi\u015f-toku\u015funun temel ilkelerine g\u00f6re garanti alt\u0131na al\u0131nd\u0131. \u00d6zel bireylerin serbest pazar i\u00e7indeki etkinlikleri, kamusal alan i\u00e7inde kendini g\u00f6steren toplumsal ve siyasal bask\u0131dan ancak bu noktada kurtulabildi.<\/p>\n<p>Ayn\u0131 zamanda, g\u00fcnl\u00fck siyasal gazeteler bu tip bir ortamda \u00f6nemli bir rol oynad\u0131lar. 18. y\u00fczy\u0131l\u0131n ikinci yar\u0131s\u0131nda, gazetecilik sadece il\u00e2nlar\u0131n yay\u0131mlanmas\u0131na yarayan bir etkinlik olmaktan \u00e7\u0131kt\u0131. Karl B\u00fccher s\u00f6zkonusu geli\u015fmeyi \u015f\u00f6yle anlat\u0131r: \u201cGazeteler salt haberlerin yay\u0131mlanmas\u0131na yarayan kurumlar olmaktan \u00e7\u0131karak parti politikas\u0131n\u0131n silah\u0131 olan kamuoyunun ta\u015f\u0131y\u0131c\u0131lar\u0131 ve liderleri olmaya ba\u015flad\u0131lar. Haber toplama ve haber yay\u0131mlama aras\u0131nda yeni bir unsur kendisini g\u00f6sterdi: edit\u00f6rler kadrosu. Gazete sahipleri i\u00e7in gazete edit\u00f6rlerinin ortaya \u00e7\u0131kmas\u0131, kendilerinin, en son haberleri yay\u0131mlayan haber sat\u0131c\u0131lar\u0131 olan kimliklerinin kamuoyunu pazarlay\u0131c\u0131lar\u0131 haline gelmesine yola\u00e7t\u0131.\u201d Yay\u0131nc\u0131lar gazeteleri ticari hale getirmeden, gazetelerin varolu\u015funu ticari bir temele oturttular. Bas\u0131n-yay\u0131n, yaln\u0131zca haberlerin yay\u0131mlanmas\u0131yla u\u011fra\u015fan bir organ olmaktan \u00e7\u0131k\u0131p kamunun izleyebilece\u011fi tart\u0131\u015fmalar\u0131n arabulucusu haline geldi. Bununla birlikte bu a\u015famada, bas\u0131n-yay\u0131nc\u0131l\u0131\u011f\u0131n t\u00fcketim k\u00fclt\u00fcr\u00fcn\u00fc te\u015fvik eden bir kurum olmas\u0131 hen\u00fcz s\u00f6zkonusu de\u011fildi.<\/p>\n<p>Bu tip bir gazetecilik, k\u00fc\u00e7\u00fck politik gruplar\u0131n ve \u00f6rg\u00fctlerin kendi seslerini duyurduklar\u0131 gazetelerin ortaya \u00e7\u0131kt\u0131\u011f\u0131 d\u00f6nemlerde g\u00f6zlenebilir &#8211; \u00f6rne\u011fin, Paris 1789 gibi. 1848 Paris\u2019inde bile hemen her politikac\u0131 kendi grubunu \u00f6rg\u00fctledi: sadece \u015eubat ve May\u0131s aylar\u0131 aras\u0131nda 450 politik dernek ve 200 dergi kuruldu. Siyasal olarak i\u015flevsel bir siyasal alan\u0131n yasalla\u015ft\u0131r\u0131lmas\u0131na de\u011fin, siyasal gazetelerin ortaya \u00e7\u0131kmas\u0131, kamuoyunun, \u00f6zg\u00fcrl\u00fc\u011f\u00fcn ve buna ba\u011fl\u0131 olarak da bir prensip olarak kamusal alan\u0131n savunulmas\u0131 sava\u015f\u0131m\u0131na kat\u0131lma anlam\u0131na geldi.
